  6. APPROVE Minutes of Meeting of November 16, 2006.
    1. CONFIRM Commissioners McGowan and Ferguson to Continue Serving as Chair and Vice-chair of the Commission, Respectively, for a Second Year (2007) Pursuant to Section 29739 of the Delta Protection Act.
    2. CONFIRM the Following Four Commissioners, Whose Terms Expire in 2007, for an Additional Four-year Term, Pursuant to Section 29736, Commencing as Noted: Don Notolli (January 07), Leroy Ornellas (January 07), Kathy Kelly (March 07), and David Johnson (May 07).
    3. DIRECT Staff to Return to the Commission with a Recommended Policy (consistent with the Delta Protection Act) for Commission Election of Chair and Vice Chair to Take Effect January of 2008.
  7. AUTHORIZE Revised Membership of Commission Budget Committee to be Comprised of a State, County and Water Agency Representative to Focus on the Development of a Plan for Commission Member Contributions to Commission Budget, and Draft Memorandum of Understanding for Implementation, Consistent with the Funding Strategy of the 2006-2011 Strategic Plan (pdf).
  8. AUTHORIZE Discontinuance of the Commission CALFED Committee Pursuant to Representation of the Commission, by Several Members, on the Delta Vision Stakeholder Committee.
  9. Receive Overview of the Draft Flood Safe California (Rebuilding the System, Reducing the Risk) Prepared by the Department of Water Resources (pdf) and Input Provided by Commission Executive Director (pdf).

    Regular Agenda

    1. Receive and Consider Information Provided by Commission Staff Including:
      1. Summary of Actions Taken by the Yolo County Board of Supervisors (County) on October 24, 2006 to Approve the Clarksburg Old Sugar Mill Specific Plan (OSMSP) and Environmental Impact Report (EIR) (Clarksburg Project).
      2. Appeals of Actions Taken by the County Filed with the Delta Protection Commission (Commission) on November 3, 2006 by the Concerned Citizens of Clarksburg and by Earth Justice on Behalf of the Natural Resources Defense

      Council (NRDC).

      1. Policies of the Commission's Land Use and Resource Management Plan for the Primary Zone of the Delta (Management Plan) Adopted February 23, 1995 and Cited in the Appeals.
    2. Conduct Public Hearing Relative to Consistency/inconsistency of the Clarksburg Project (as Approved by the County on October 24, 2006) With the Policies of the Management Plan Cited in the Appeals, Including Testimony from the County, Project Applicant, Appellants, and the General Public.
    3. Receive Commission Member Input and Comments Relative to Whether the Project is Consistent/inconsistent with the Policies of the Management Plan Cited in the Appeals.
    4. Determine that:
      1. The Clarksburg Project is "Consistent" With one or More of the Following Policies of the Management Plan Cited in the Appeals: Agriculture Policy 4; Land Use Policy 2; Land Use Policy 3; Land Use Policy 4; Land Use Policy 7; Utilities and Infrastructure Policy 3; Levees Policy 1; Levees Policy 2; Levees Policy 3; Levees Policy 4 and/or Levees Policy 5; and
      2. The Clarksburg Project is "Inconsistent" With one or More of the Following Policies of the Management Plan Cited in the Appeals: Agriculture Policy 4; and Use Policy 2; Land Use Policy 3; Land Use Policy 4; Land Use Policy 7; Utilities and Infrastructure Policy 3; Levees Policy 1; Levees Policy 2; Levees Policy 3; Levees Policy 4 and/or Levees Policy 5.
    5. Direct Staff to Return to the Commission on February 22, 2007 With Recommended Findings for Adoption as to Consistency/inconsistency of the Clarksburg Project With the Policies of the Management Plan Cited in the Appeals Pursuant to Actions Taken by the Commission.
    6. Receive Tolling Agreement Relating to Potential Challenges to Certain Actions of the Delta Protection Commission (Attachment A).
  16. ADJOURNMENT
    1. Adjourn in Memory of Helen Shaffer. (Mother of Commissioner Steve Shaffer).
    2. Adjourn in Memory of John Hansen. (Well respected engineer in the Delta).
